Overview Of Spousal Sponsorship
Canadian citizens and permanent residents can sponsor a spouse or common-law partner for permanent resident status. The sponsor must sign an agreement with the Canadian government to provide financial support for three years.
Obtaining a spousal visa is generally more flexible than other visa types, as there are no strict requirements for education, language skills, or work experience. Once sponsored, the spouse can live, work, and reside permanently in Canada.
They Are of 2 Types:
- OUTLAND SPOUSAL SPONSORSHIP – for sponsored partner residing outside Canada, the application for PR should be submitted to Case Processing Centre in Sydney, Nova Scotia IRCC
- INLAND SOUSAL EXPRESS ENTRY – for the sponsored partner living together in Canada under temporary Canadian status, either as worker, student or even visitor. Inland application should be submitted to Case Processing Centre in Mississauga, Ontario IRCC.
Processing Time
The processing time for the applicants for Canadian spouse sponsorship may take 12-26 months. The processing time varies from country to country and also depends upon the documents submitted.
Five Year Sponsorship Ban:
A person who became a permanent resident or a Canadian citizen after being sponsored as spouse, common-law partner or conjugal partner is barred from sponsoring a spouse or partner within five years of becoming a permanent resident, even if they acquired citizenship during that period. The five years is counted back from the day on which the sponsorship application – as part of a complete application package – is received by Immigration, Refugees and Citizenship Canada (IRCC).
A sponsor who became a permanent resident or a Canadian citizen after being sponsored as a spouse, common-law partner or conjugal partner may not sponsor a foreign national referred to as a spouse, common-law partner or conjugal partner unless the sponsor has been a permanent resident or a Canadian citizen, or a combination of the two, for a period of at least five years immediately preceding the day on which a sponsorship application is filed by the sponsor in respect of the foreign national.
